This is our privacy notice for our customers. “We”, “our”, “us”, when used in this notice, means Sun Bancorp Inc., Sun National Bank, Sun Financial Service, LLC and/or Sun Home Loans, Inc. When we use the words “you” and “your” we mean the following types of consumer customers (and former customers) who have or had a continuing relationship by purchasing or holding financial products or services such as:
• Deposit account
• Loan account
• Safe deposit box
• Self-directed Individual Retirement Account
• Financial, investment or economic advisory services
Nonpublic personal information means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records. After this, we will use the term "information" to mean nonpublic personal information as defined in this section.
An affiliate is a company we own or control, a company that owns or controls us, or a company that is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control.
A nonaffiliated third party is a person we do not employ or a company that is not an affiliate of ours.
For us to establish and administer your accounts; to satisfy certain regulatory requirements and to better understand you so that we may provide you with additional or improved products and services, we collect nonpublic personal information about you from the following sources:
• Information we receive from you on applications or other forms (e.g. name, address, social security number);
• Information about your transactions with us, our affiliates, or others (e.g. payment history, account balance);
and
• Information we receive from a consumer reporting agency (e.g. your credit history).
We will not disclose information about you to anyone except as disclosed in this policy or as permitted by law. Examples of this might include disclosures necessary to service your account or prevent unauthorized transactions.
We occasionally share your information under the following circumstances:
Sharing Your Information with Our Affiliates
Within our family of affiliated financial service providers, we are permitted to share non-public information necessary for conducting business. We are permitted by law to share:
• Transaction information such as account balances and payment history from our account records;
• Identifying information including your name, address account activity and types of accounts.
Other information
If you have a relationship with us and express interest in a product or service offered by another affiliate, that affiliate may request your permission to obtain from us other non-public information. This may include your credit report, income, application information and your credit score.
Affiliate Marketing
Our affiliate companies do not use the information of the other affiliate companies and their customers for marketing purposes. As permitted by law, in our efforts to better serve your financial needs, any affiliate company with whom you do have an existing relationship may market to you their own products, the products of an affiliate or ask to refer you to another affiliate whose products may be of benefit to you.
Sharing Your Information with Nonaffiliated Service Providers and Joint Marketers
It is sometimes necessary for us to provide information such as your transaction history, account balance, name and address to a third party who provides services for us. This may include vendors who prepare account statements, process checks or provide support for one of our products or services. We are permitted by law to disclose this information when our contract with these service providers specifies that our vendors must:
• Abide by applicable privacy laws and reflect our commitment to the confidentiality of your information;
• Use it only for the purpose for which it was originally disclosed.
We may share the information noted in The Information We Collect and May Disclose with companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements.
Sharing Your Information with Nonaffiliated Third Parties as Permissible by Law
We only make disclosures of our current and previous customers' nonpublic personal information to other nonaffiliated companies as permitted or required by law. These disclosures include but are not limited to sharing nonpublic personal information:
• When we have received your prior consent;
• When necessary to complete a transaction you have initiated, such as a credit or debit card purchase;
• With a reputable credit bureau or similar consumer reporting agency;
• As authorized or required by law or in response to the judicial process.
We do not sell, share or rent our customer information lists to nonaffiliated third parties for their own marketing, solicitation or similar purposes.
The above sharing practices are compliant with Federal law. If you reside in a State that places stricter limits on sharing information about you, we will maintain that information in accordance with your State law.
We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information. We strive to keep your information as accurate as possible. If you believe there is any information about you that is not accurate please call us immediately at 1-800-691-7701. We will respond to your requests to correct inaccurate information in a timely manner.
We recognize that protecting children’s identities and privacy on-line is important and that the responsibility to do so rests with both the on-line industry and with parents. We do not knowingly solicit data from children under the age of 13, and we do not knowingly market through our website to such children.
We may report information about your account to credit bureaus. Late payments, missed payments, or other defaults on your account may be reflected in your credit report.
Federal Law requires us to provide this notice to customers before any "negative" information may be furnished to a nationwide consumer reporting agency. "Negative information" means information concerning delinquencies, late payments, insolvency, or any form of default. This notice does not mean that we have or will be reporting such information about you. After providing this notice, additional negative information may be submitted without providing further notice.
Do not respond to e-mails, phone calls or letters that ask you to verify or provide personal or bank information.
